Agreement
These Terms of Service (“Terms”) are an agreement between GetFloristPOS (the legal entity named on your invoice), referred to as “we”, “us” or “our”, and the business that signs up for the service (“you”). They cover the hosted GetFloristPOS point-of-sale software, the auto-generated online store, the mobile app, any managed website we build for you, and this marketing website (together, the “Service”).
By starting a trial, creating an account or paying an invoice, you agree to these Terms on behalf of your business, and you confirm you are authorized to do so. If you do not agree, do not use the Service. These Terms are written in plain language, but they are a binding contract. They are not legal advice; if you need advice about your own obligations, speak to a lawyer in your country.
The Service
GetFloristPOS is hosted software, delivered over the internet. There is nothing to install on a server. Depending on your plan, it includes counter checkout, delivery date and time-slot scheduling, perishable stock with lot and expiry dates, an online store built from your catalogue, wire order queues, event orders with deposits, arrangement recipes, multi-location stock transfers, and optional modules such as accounting and staff management. The features in each plan are listed on the pricing page, and may be improved over time.
We may change or update features. We will not remove a core feature included in your paid plan during a billing period you have already paid for without giving you notice and, where the change materially reduces what you paid for, a pro-rated credit.
Integrations and third parties
Some features connect to services we do not own, such as your card payment processor, relay networks for wire orders, WooCommerce, accounting tools, and messaging services. Wire-order networks connect by integration through the API connector, set up with you during onboarding. We are not a partner or agent of any relay network, and their own terms and fees apply to your account with them. We are not responsible for the availability, pricing or conduct of third-party services.
Accounts and users
You must give accurate sign-up details and keep them current. You are responsible for everyone who uses your account, for the roles and permissions you assign to staff, and for keeping passwords private. Tell us at once if you suspect unauthorized access. User limits per plan are listed on the pricing page.
Free trial
New accounts get a 14-day free trial. No payment is taken during the trial. At the end of the trial, the account pauses unless you choose a plan. Data you entered during the trial is kept for a short period so you can pick up where you left off, and is then deleted as described in the Privacy Policy.
Plans, fees and billing
Billing periods
You can pay monthly or annually. Annual billing is priced at ten months for twelve, which means two months free compared with paying monthly. There is no long-term contract beyond the billing period you choose.
Prices and taxes
Prices are set per market (USA in USD, UAE in AED, Pakistan in PKR) and shown on the pricing page. UAE prices include 5% VAT. US and Pakistan prices are shown before applicable sales tax, which is added at checkout or on the invoice. Fees are charged in advance at the start of each billing period. Extra locations, the managed website and bundles are priced separately as listed.
Price changes
We may change prices for future billing periods. We will give you at least 30 days’ notice before a price change applies to your account. A change never affects a period you have already paid for.
Failed payments
If a payment fails, we will tell you and try again. If it is still unpaid 14 days after the due date, we may restrict the account to read-only until payment is made. We will not delete your data because of a late payment without first giving you a further written notice and a chance to export.
No commission on your orders
We charge a subscription, not a percentage of your sales. We take no commission on orders you take through the point of sale or the online store.
Payments to your shop
Card payments from your customers are processed by your own payment processor, under your own merchant agreement. The Service works with your processor, but we are not a payment processor, money transmitter or bank, we do not hold your customers’ funds, and we are not a party to transactions between you and your customers. Disputes, chargebacks and processor fees are between you and your processor. Custom payment methods you record (such as gift cards, JazzCash or Easypaisa) are records only, unless an integration you enable says otherwise.
Cancellation
You can cancel at any time from your account settings or by contacting us. Cancellation takes effect at the end of the current billing period; you keep full access until then. We do not charge cancellation fees. Refunds are covered by our Refund Policy, which forms part of these Terms. In short: monthly fees are not refunded, annual fees can be refunded pro rata if you cancel within 30 days of an annual renewal, and the managed website setup fee is non-refundable once design work starts.
We may suspend or end your account if you seriously or repeatedly break these Terms, use the Service unlawfully, or put other customers or our systems at risk. Where reasonable we will warn you first and give you time to fix the problem.
Managed website
If you buy the managed florist website, we design and host a site on your domain. The setup fee covers design and build and is non-refundable once design work has started. Monthly website fees cover hosting, SSL, backups and the agreed monthly edits. You must own or control the domain and give us accurate content. You are responsible for the products, prices and claims on your site. If you cancel, we will hand over your domain settings and your content; designs, code and templates we created remain ours unless agreed otherwise in writing.
Your data
You own it
You own all data you or your staff put into the Service: products, customers, orders, stock, staff and financial records (“Your Data”). You give us permission to host, copy, process and display Your Data only as needed to provide, secure and support the Service for you.
Export
You can export Your Data at any time while your account is active, using the built-in exports and reports, and for 30 days after cancellation. On request during that window we will help you export it in common formats such as CSV. After that, we delete Your Data as set out in the Privacy Policy.
Your responsibilities
You are responsible for having the right to collect and use your customers’ and staff members’ personal data, for giving them your own privacy notice, and for complying with laws that apply to your shop, including tax, consumer protection, data protection and marketing laws in the USA, the UAE or Pakistan. We act as your processor or service provider for that data and will follow your documented instructions, keep it confidential, protect it with reasonable security, help you answer data requests, and tell you without undue delay about a security breach affecting it. Our Privacy Policy has more detail.
Acceptable use
You must not use the Service to break the law, send spam, store unlawful content, infringe anyone’s rights, probe or attack our systems, resell the Service without our written agreement, or copy or reverse engineer the software except where the law allows. You must not upload malware or attempt to access another customer’s data.
Our intellectual property
The software, design, documentation and branding of the Service belong to us or our licensors. During your subscription we grant you a non-exclusive, non-transferable right to use the Service for your own business. Feedback you give us may be used to improve the Service without obligation to you.
Availability and support
We aim to keep the Service available around the clock and to schedule maintenance outside busy shop hours, avoiding the weeks before Valentine’s Day and Mother’s Day where we can. We do not promise uninterrupted service. Support is available through our US, UAE and Pakistan desks during the hours shown on the contact page.
Warranties and disclaimers
We will provide the Service with reasonable skill and care. Apart from that, and to the extent the law allows, the Service is provided “as is” and we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement. Tax rates, receipts and reports are tools: you remain responsible for checking that your tax settings and filings are correct. Nothing in these Terms limits rights you have under consumer protection laws that cannot be excluded.
Limitation of liability
To the extent the law allows, neither party is liable for indirect, incidental, special or consequential losses, or for lost profits, revenue or goodwill, even if warned. Our total liability arising from the Service in any 12-month period is limited to the fees you paid us in that period. These limits do not apply to liability that cannot be limited by law, such as fraud, or to your obligation to pay fees.
Indemnity
You will defend and compensate us against third-party claims arising from Your Data, your products and sales, or your breach of these Terms or the law.
Governing law and disputes
These Terms are governed by the laws of the country of the entity named on your invoice, without regard to conflict-of-law rules, except where mandatory local law where you are based gives you other rights. Before going to court, both sides will try in good faith to settle any dispute by talking for at least 30 days. Contact us first; most problems are fixed with a phone call.
Changes to these Terms
We may update these Terms. If a change is material, we will tell account holders at least 30 days before it takes effect. If you do not agree, you can cancel before the change applies and the current Terms will continue until the end of your billing period.
General
If part of these Terms is found unenforceable, the rest still applies. Failing to enforce a right is not a waiver. You may not transfer your account without our consent; we may transfer these Terms to a successor business. These Terms, the Refund Policy, the Privacy Policy and any order form are the whole agreement between us about the Service.
