Our policy
GetFloristPOS (the legal entity named on your invoice) respects intellectual property and expects the florists who use our service to do the same. Florists upload product photos, descriptions and other content to their online stores, which are hosted on our platform. If you believe content on getfloristpos.com or on a store we host infringes your copyright, you can ask us to remove it.
We respond to notices under the US Digital Millennium Copyright Act, 17 U.S.C. § 512, and we handle complaints from the UAE, Pakistan and elsewhere in the same way.
How to send a notice
Send your notice to our designated copyright agent using the contact form at /contact with the subject Copyright notice, or to the address shown via the Show email button on /contact. Your notice must include:
- Your physical or electronic signature, or that of a person authorized to act for the copyright owner.
- Identification of the copyrighted work you say is infringed, or a representative list if several works are covered.
- Identification of the material you say is infringing, with enough detail for us to find it, such as the page address and a description of the image or text.
- Your name, postal address, telephone number and a way to reach you.
- A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent or the law.
- A statement that the information in the notice is accurate and, under penalty of perjury, that you are the owner or authorized to act for the owner.
Incomplete notices may delay our response. Under § 512(f), a person who knowingly misrepresents that material is infringing may be liable for damages. Consider whether the use may be fair use before you send a notice.
What we do next
When we receive a valid notice, we will remove or disable access to the material promptly, tell the florist or person who posted it, and give them a copy of the notice. Where the content belongs to a florist’s store, we may also ask the florist to remove it themselves.
Counter-notice
If your content was removed and you believe that was a mistake or that you had the right to use it, you can send a counter-notice through the same route. It must include:
- Your physical or electronic signature.
- Identification of the material removed and where it appeared before removal.
- A statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification.
- Your name, address and telephone number, and a statement that you consent to the jurisdiction of the US federal district court for your address (or, if you are outside the United States, any judicial district in which we may be found), and that you will accept service of process from the person who sent the original notice or their agent.
We will send the counter-notice to the person who complained. Unless they tell us within 10 business days that they have filed a court action, we may restore the material 10 to 14 business days after receiving the counter-notice.
Repeat infringers
We will suspend or close the accounts of users who are found to be repeat infringers in appropriate circumstances.
Complaints from the UAE, Pakistan and elsewhere
If you are in the United Arab Emirates, Pakistan or another country, send the same information listed above, together with the law you rely on, such as UAE Federal Decree-Law No. 38 of 2021 on Copyright and Neighbouring Rights or Pakistan’s Copyright Ordinance 1962. We will review it and act where appropriate. Trademark complaints are welcome through the same route.
This page is not legal advice. If you are unsure whether material infringes your rights, take advice from a qualified lawyer.
